The U.S. Space Force’s prospective chief may have thrown cold water on the idea of space privateers, but the real question isn’t whether they exist; it’s whether the military has grasped the extent to which private enterprise already dominates critical space infrastructure. This isn’t a theoretical debate for a distant future. Instead, it reflects a deeply rooted, perhaps even quaint, understanding of power projection in the 21st century’s newest battlespace.
For centuries, nations have outsourced military operations to private entities, particularly at sea. The historical record shows early U.S. presidents, including John Adams, employed privateers during the Quasi-War with France in the late 18th century. These captains, operating under letters of marque and reprisal, were authorized to “subdue, seize, and take any armed French vessel” — a crucial stopgap for a nascent U.S. Navy.
This historical context, while valuable for understanding the concept of privateering, fundamentally misframes the discussion surrounding space. The public debate around ‘space privateers’ itself often feels like a relic, framed by historical analogies that fail to capture the contemporary challenges of space power and national security. The true ‘privateers’ of space are already aloft, their presence so integrated into global infrastructure that labeling them as such misses the point entirely.
The Commercial Constellation: Not Your Grandfather’s Privateer
Today’s commercial space sector bears little resemblance to the 18th-century merchant ships outfitted with a few cannons. Companies like SpaceX, Viasat, and Amazon’s Kuiper aren’t just launching satellites; they are building vast satellite constellations that provide global communications, precision navigation, and geospatial intelligence. These networks form the backbone of modern society, from banking transactions to battlefield communications.
When a Ukrainian military unit relies on Starlink terminals for battlefield connectivity, or when global positioning systems (GPS) — originally a military technology — become indispensable for civilian logistics, the line between private and public, commercial and military, irrevocably blurs. These are not privateers in the historical sense, actively engaging in combat for a government; they are ubiquitous, dual-use technology providers. Their services, while commercial, hold profound strategic implications.
The current Space Force stance appears to focus on preventing a direct replication of historical privateering: private entities armed by the state to engage enemy assets. However, this perspective overlooks the far more insidious and influential role of commercial entities whose data streams, imagery, and communication relays are already vital for any modern military operation. The question is not if private actors will operate in space, but how their undeniable capabilities will be governed and integrated without explicit command and control.
Defining Control in a Hybrid Space Future
The skepticism from the prospective Space Force chief is an attempt to assert a traditional military prerogative in a domain that has never truly been traditional. This insistence on clear lines, while understandable from an institutional perspective, largely serves to buttress the Space Force’s evolving doctrine and maintain its exclusive authority over military operations in orbit. It’s a scramble to define boundaries before the reality on the ground — or rather, in orbit — makes those distinctions irrelevant.
Commercial space firms are not waiting for governmental directives to innovate or expand. They are driven by market incentives, rapid technological advancements, and the burgeoning orbital economy. This dynamic creates a critical tension: national security relies heavily on these private assets, yet military doctrine struggles to accommodate actors outside direct state control.
Consider the analogy to cyber warfare, where attribution is notoriously difficult and non-state actors, sometimes state-sponsored, blur the lines of conflict. In space, commercial satellite operators already hold keys to critical infrastructure and data, making them prime targets or unwilling auxiliaries in any conflict. Ignoring this reality by simply rejecting the term ‘privateer’ does little to address the profound security challenges of dual-use technologies in orbit. The Outer Space Treaty of 1967 already complicates direct state weaponization, but it offers little clear guidance for the liabilities or protections of a private SpaceX Starshield satellite operating under contract.
The Space Force cannot simply wish away the commercial layer of space. Its real challenge lies in developing sophisticated frameworks for collaboration, regulation, and — crucially — resilience, that acknowledge and integrate private capabilities. This means moving beyond historical analogies and confronting the complex, hybrid nature of space power, where the most potent ‘privateers’ are not rogue ships, but vast networks of data and communication already essential to national defense.
